Attorneys for former Stoughton Police Officer Matthew Farwell said in a new legal filing that federal prosecutors are acting in bad faith. Farwell is currently on trial for allegedly murdering 23-year-old Sandra Birchmore and causing the death of her unborn child in February 2021. Calls of bad faith from Farwell's attorney came after the government filed a renewed motion to include testimony from three women the ex-cop allegedly had affairs with during his marriage. Although a judge already ruled against including the evidence, prosecutors argued that defense attorney Kimberly Stevens invited the testimony's admittance when she said in her opening statement Friday that Farwell was wearing a mask to Birchmore's apartment in an attempt to conceal the relationship from his wife. To refute that claim, prosecutors want to call women who had alleged affairs with Farwell to the stand to testify to the degree Farwell did or did not try to hide the relationships from his wife, including whether he wore a mask during their encounters or made them delete text messages between them. But the defense said that Stevens' opening was misconstrued by the government. They claim that defense counsel, in her opening statement, opened the door to this line of inquiry. The prosecution is wrong and is acting in bad faith, Farwell's other attorney Joanne Daley wrote. Daley argued that prosecutors mischaracterized Stevens' statements, putting in direct quotes from her opening and attaching as an exhibit a transcript of the proceedings. The defense motion noted: Ms. Stevens actually said, Matthew Farwell is a man who had an affair. He's made regrettable mistakes. He's human. Matthew Farwell did not kill Sandra Birchmore. He did not… There's snow on his hood and he's wearing a mask, which is what people having an affair might do… In fact, [prosecutors] pointed to you the one thing they could point to you in the opening, that she might tell his wife. Make no mistake. His wife is not a federal law enforcement officer.' Daley said that the argument that Farwell wore a mask to conceal his relationship #thenewsherald #CrimeInTheD ®
