The Los Angeles Police Department alleges the two were in a sexual relationship that began in 2023, when Rivas Hernandez was 13 and Burke was 18, according to court documents. They met in 2022, according to an investigation by Los Angeles police robbery-homicide detectives.

Texts between the two referred to sex, pregnancy, abortion and Plan B, court documents said. Explicit photos also indicate the two were in a relationship, according to the documents.

Detectives found that in 2024, Rivas Hernandez spent summer weekends at Burke's home and traveled with him to Las Vegas, London and Texas to meet Burke's family, the court documents said.

Courtroom evidence

The preliminary hearing resembles an abbreviated trial with no jury. The judge ruled that Burke, who has been held without bail since his arrest in April, must remain shackled to his chair, though his hands may remain uncuffed, the Associated Press reported.

On Tuesday, prosecutors showed body-camera footage of Burke telling deputies investigating Rivas Hernandez's disappearance that he had met Rivas Hernandez, then 13 years old, only once in person and did not know she was a minor, the Associated Press reported.

Prosecutors also showed photos of Rivas Hernandez's dismembered body. The courtroom included Rivas Hernandez' parents, along with reporters and members of the public, the AP reported.

Rivas Hernandez's cellular activity ceased on April 23, 2025, the date the state believes she died, according to court documents.

The night before, she and Burke got into a  lengthy argument,  according to court documents. Messages show Rivas Hernandez was jealous of Burke's relationships with other women and threatened to share information about their relationship to  end his career and destroy his life,  court records said.

Burke's first studio album was set to be released two days later, and he had multiple  highly profitable  product endorsements, court documents said.

At approximately 8:40 p.m., Burke sent an Uber to take Rivas Hernandez to his home, court documents said. She arrived at approximately 10:10 p.m., and at 10:30 p.m., Burke sent messages asking where she was, the documents said.

The prosecution's hearing brief says the state believes the messages were part of a premeditated plan to cover up the killing. Prosecutors allege Burke stabbed Rivas Hernandez multiple times and allowed her to bleed to death. He did not call law enforcement or 911.
