A judge ruled Thursday that the case of a 16-year-old boy charged in Milwaukee's 414 Day murder will go to adult court.

The 16-year-old boy, whose identity cannot be disclosed, is one of three juveniles accused of attempting to rob David Krause before fatally shooting him in the Walker's Point neighborhood in April.


Part of the teen's waiver hearing, Thursday's closing arguments came after a full day of testimony on Tuesday.

Prosecutors argued for the teen to be waived to adult court, where he could face harsher penalties if convicted.

 Not only do we have someone who lost their life, but we have somebody who lost their life over virtually nothing,  prosecutor Gilbert Urfer said.

The defense, however, pointed to the teen's difficult upbringing in their argument to keep the case in juvenile court.

 What we have here is a child, with a few exceptions, has heard shrieks, shouts, curses, screaming, people getting hurt from the time he was a baby,  defense attorney Kimberley Bayer said.

Judge Milton Childs ultimately decided to waive the teen to adult court, a departure from his decision last week for one of the other teens charged in the same case.

 This has been an absolute emotional roller coaster, and unfortunately, this is just the beginning, you know?  Krause's sister Ashley Krause said following the hearing.  We just want everyone to know that there are people out there that cared for him. And I think based on the decision that was ruled last week, we're kind of questioning whether the court felt the same way, so we'll continue to show up for David for every single one of these. 

Following the ruling, the judge set a $100,000 bail for the 16-year-old.

The third and final teen in custody in connection to Krause's death is set to have his waiver hearing in August.
