One of the three male jurors in the Lindsay Clancy mistrial believes the outcome would likely be different if the state of Massachusetts decides to retry the killer mom.

The district attorney who brought first-degree murder charges against Clancy is now weighing whether to go to trial again, negotiate a plea deal, downgrade the charges, or drop them altogether after the high-stakes trial ended with a mistrial on Friday.

 I think if they tried the trial again the way they did, I think nine times out of 10 a jury would come back with not guilty by reason of insanity,  he told ABC in an interview broadcast Thursday morning on  GMA.

After a week of deliberations, the 12-member jury - composed of nine women and three men - failed to reach a unanimous verdict on whether to convict the 36-year-old Duxbury mother of murder for strangling her three kids, Cora, 5, Dawson, 3, and Callan, 8 months, on Jan. 24, 2023.

The jury penned a note to Judge William Sullivan on Thursday, warning that they were deadlocked and stating that  one juror refuses to listen to the law. 

Clancy's attorney Kevin Reddington attempted to leverage this to convince the judge the lone holdout juror should be dismissed, but he declined to do so and officially declared a mistrial on Friday.

Dargie, 25, who was at first reluctant to come forward but felt compelled to explain after what he witnessed in the deliberation room, said he found the prosecution's case  inconsistent,  and believed experts called by the defense team were  more believable.
