A 4-year-old boy is dead after drowning in a Chattanooga apartment complex pool, and police say a man responsible for watching him wasn't there when the child spent about nine minutes underwater.

Now, 22-year-old Deshundre Vinson, the young boy's uncle, faces charges.

Chattanooga Police say after the drowning, Vinson and the person who held the lease at his apartment left and could not be found. Two and a half weeks later, police found him at a home on Laws Avenue and took him to the Hamilton County Jail.

Our newsroom obtained an arrest affidavit that identifies Vinson as the uncle who was babysitting the 4-year-old, his 6-year-old brother, and other children when the drowning happened back on Aug. 16.

Investigators say Vinson let the two young boys walk about two-tenths of a mile to the apartment complex pool without an adult.

No parent, guardian, or caregiver was at the pool with them, according to the affidavit.

Nine minutes underwater

Chattanooga Police were already at the apartment complex that day on an unrelated call when officers heard screaming coming from the pool area.

They ran toward the screams and found people performing CPR on the 4-year-old.

Detectives later reviewed surveillance video showing the child walk from the edge of the pool into deeper water, according to the affidavit.

That report cites video that shows the boy struggling before going underwater.

He remained there for about nine minutes.

Someone nearby then pulled the unconscious child from the water and started CPR.

First responders rushed him to Erlanger Hospital, where he died five days later, according to the report

Police say messages acknowledged lack of supervision

In the affidavit, investigators say messages Vinson sent to the boys' mother acknowledged both the lack of supervision and a delayed response after the drowning.

Police also noted a sign at the pool warning that children younger than 14 should not use the pool or water without an adult somewhere nearby
