 That levee was safe. I was on that levee the night before the break,  Scholz said.  It wouldn't have broken absent the deranged, psychopathic actions of actually pulling off the sandbags. 

Former Cole County Prosecutor Bill Tackett said Scott's conviction under the  causing a catastrophe  statute, the only such conviction in Missouri history, presents a significant hurdle for the parole board.

 It's very difficult to be charged or convicted with this because it takes a catastrophe obviously to happen, and that's difficult to do,  Tackett said.

Tackett said the scale of the damage Scott was convicted of causing weighs heavily on any release decision.

 The level of damage that was caused on top of the level of damage that was already occurring added to this,  Tackett said.  That's the kind of thing that when you're considering releasing them into the community that's very difficult to do.
